The husband of a woman killed in a car crash on North Whidbey is suing the driver of the car, as well as the driver’s parents.
Molly Rice, a 29-year-old Oak Harbor resident, died in a one-car accident on Reservation Road Feb. 24. The State Patrol reported that the driver, 29-year-old Raymond Prokop of Oak Harbor, was driving at 80 to 85 miles per hour when the car struck a power pole, according to court documents.
Rice was not wearing a seat belt and was thrown from the car.
Terence Rice’s attorney, Jacob Cohen, filed a complaint for monetary damages for wrongful death in Island County Superior Court June 22.
The complaint was filed both against Prokop and his parents because they allegedly furnished him with the 2005 Nissan 350Z. The complaint states that the parents are legally liable under the “Family Purpose Doctrine,†which holds parents liable for injuries caused by a child’s negligent driving or other actions.
Prosecutors charged Prokop in Island County Superior Court with one count of vehicular homicide. Under the charge, Prokop is accused of causing the fatal accident by operating the car in a reckless manner.
In the complaint, Cohen states that Prokop caused pain and suffering to both Molly Rice and her husband. The complaint asked for general and special damages, as well as attorney’s fees.
Prokop’s attorney said he had no comment about the civil or criminal cases.
