Sheriff discusses sex offender

New Island County Sheriff Mark Brown will hold his first sex-offender meeting on North Whidbey next Tuesday.

Brown set up the meeting for 6 p.m. at the Taylor Road Fire Station to discuss one of two sex offenders who moved to the north end of the island this week.

Steven Burt, 27, is a sex offender who’s now living at a home on Kinzie Road. The Sheriff’s Office classified him as a Level 2, which means he’s considered a moderate risk to reoffend.

In addition, a high-risk sex offender is living homeless in the Oak Harbor area. Devin Ness, 19, was classified as a Level 3 sex offender, largely because of his homeless status.

Burt was convicted of third-degree child rape in Whatcom County in 1994. He was 15 years old when he used bribery, trickery, and manipulation to convince a 12-year-old developmentally-disabled female relative to have sexual intercourse, the Sheriff’s Office reported.

Burt also engaged a non-familial 12-year-old, developmentally-disabled female in sexual behavior and was convicted of a lesser charge, the notification states.

Burt’s criminal history, according to the Sheriff’s Office, includes convictions for burglary, forgery and failure to register as a sex offender.

The other sex offender, Ness, has a less serious criminal history although his homelessness resulted in a Level 3 rating.

Ness was convicted of communicating with a minor for immoral purposes in Island County in 2005. He was 17 when he engaged a 11-year-old girl, to whom he was not related, in an inappropriate relationship, the Sheriff’s Office reported.

Ness’s criminal history includes convictions for residential burglary, third-degree theft and fourth-degree assault, according to the Sheriff’s Office.

Both Ness and Burt have completed all supervision related to their sex crime convictions. They have both served the sentence imposed by the courts and are not wanted by law enforcement. Law enforcement agencies do not have legal authority to direct where an offender lives.
