Man accused of assaulting Oak Harbor officers

Chaotic scene occurred on Pioneer Way

A South Whidbey man is accused of assaulting two Oak Harbor police officers during a chaotic scene downtown in the afternoon of July 9, according to court documents.

Oak Harbor police were called to a report of a man, later identified as 26-year-old Justin S. McArthur, throwing a rock through the window of Wells Fargo Bank on Pioneer Way, according to a police report. Two officers with the Oak Harbor Police Department were in the area on bicycle patrol and responded to the call.

The officers tried to contact McArthur, but he ignored them and walked away. They tried to physically restrain McArthur, but he punched both of them in the head and continued to attack them by hitting and kicking, an officer wrote in his report. McArthur tried to grab a Taser from one officer and a bicycle helmet from another, the report states.

During the confrontation, McArthur attempted to push his thumbs into the eyes of one of the officers. McArthur then choked the officer with the chin strap of a helmet, the police report states.

When a third officer arrived, he found two officers and a citizen lying in the roadway and restraining McArthur. The officer “relieved” the citizen of restraining McArthur’s arm; the three officers were able to turn McArthur over and handcuff him.

The two officers went to the hospital ER for treatment. One of the officers suffered swollen, bloodshot and red eyes from the thumb assault.

McArthur appeared in Island County Superior Court the next day. The judge found probable cause existed to believe he may have committed the crimes of two counts of assault in the third degree and malicious mischief. The judge ordered him held on $20,000 bail.

Court documents indicate that McArthur has a Clinton address but is currently homeless. He has a history of vandalism and assault.

On Feb. 10, McArthur pleaded guilty to assault in the second degree — a domestic violence crime — for beating his girlfriend, who suffered multiple fractures to her nose and face. He was sentenced to five months in jail.
