Man accused of assault, shooting bed

A North Whidbey man is accused of aiming a gun at his girlfriend and shooting a mattress on March 8, according to court records.

Donny W. Banes, 41, appeared in Island County Superior Court March 9, and the judge found probable cause existed to believe he committed the crimes of assault in the second degree, assault in the fourth degree and unlawfully aiming a firearm. The assault charges are considered domestic violence crimes.

The judge set Banes’ bail at $10,000.

Banes called 911 to report that his girlfriend bit him on the hand after they had a party around a bonfire on a Frostad Road property. He told the dispatcher that everyone at the party was armed.

A deputy with the Island County Sheriff’s Office responded and spoke with Banes, who said the assault occurred after the party at the house.

The woman, however, said Banes had assaulted her. She said he was sprawled out on the bed and she tried to push him over, but he woke up agitated. She said he grabbed her by the hair and shoved his fist into her mouth; the deputy saw that there were cuts on her lip, the deputy’s report states.

In addition, the woman said Banes pointed a handgun at her and then shot the mattress she was sitting on, missing her by about 18 inches, the report states.

The deputy seized multiple guns from the house, the report states.
