A 57-year-old Oak Harbor man has been charged with an assault and burglary involving Spaghettios and a hammer, court records indicate.

Prosecutors charged Manuel Escojido in Island County Superior Court April 19 with assault in the second degree, burglary in the first degree and malicious mischief in the third degree.

Oak Harbor Police Officer Jennifer Rutledge responded to a 911 report of a man armed with a hammer chasing someone outside of an apartment on SE Hathaway Street.

The alleged victim explained that he had returned a shelving unit to Escojido, who lived in a neighboring apartment, by putting it outside his door. He also gave him some cans of Spaghettios that his wife didn’t like.

The man said Escojido became angry because of where the shelf was placed and started throwing the cans of pasta at the him, the report states. Escojido chased the man into his home while brandishing a ball peen hammer, the officer wrote.

Escojido had a different version of events, though he admits that all the

trouble started because his neighbor put the shelving unit in front of the door. He said the man did in on purpose to trip him.

Escojido also claimed the other man threw the can of noodles at him, hitting his foot. He said he threatened the neighbor with a hammer to get him to leave his apartment, the report states.

If convicted of the charges, Escojido could face more than two years in prison under the standard sentencing range.
