Oak Harbor woman, 84, charged for allegedly hitting pedestrian in a crosswalk

An 84-year-old Oak Harbor woman is facing a felony charge for allegedly running over a pedestrian in a crosswalk and driving away from the scene April 15, court documents state.

The police report indicates, however, that the driver may not have realized she hit a pedestrian, who was seriously injured.

Prosecutors charged Bernice L. Matheson in Island County Superior Court Oct. 31 with hit and run with injury. The charge carries a standard sentencing range of three to nine months in jail.

The accident occurred on West Whidbey Avenue at the intersection with South Oak Harbor Street in Oak Harbor. The stretch of Whidbey Avenue between Oak Harbor Street and the highway has been problematic for the city because of the proliferation of mid-block jaywalking; the former mayor’s plans for a mid-block crosswalk were scuttled earlier this year.

This accident, however, occurred in an existing crosswalk and the pedestrian had the right of way, according to the police report.

Officer Mel Lolmaugh with the Oak Harbor Police Department responded to the collision as medical personnel were helping the 69-year-old victim.

Doctors later told the officer that two bones in the pedestrian’s left leg were broken, as were the bones in both her feet. A doctor also said the woman may have suffered a compressed spine injury.

A witness to the accident told officers that the victim was crossing the intersection as the light had turned green.

An SUV eastbound on Whidbey Avenue was turning right onto Oak Harbor Street and struck the pedestrian. The SUV continued on without stopping.

The witness saw the suspect’s SUV driving by as she was speaking to the officer about the accident. Lolmaugh jumped in his car and pulled the SUV over, according to the report.

Matheson, who was driving, said she didn’t remember seeing or hitting a pedestrian, but admitted she heard something hit the side of the car. Matheson said she continued driving since she didn’t see anything in her mirror, the report states.
