Oak Harbor man accused of kidnapping, rape

An Oak Harbor man was armed with a handgun when he entered the bathroom where his estranged wife had been showering and raped her on Dec. 28, according to court documents.

The man, 36-year-old Robert Boese, then blocked the woman from leaving the home, according to a report by a deputy with the Island County Sheriff’s Office.

Boese appeared in Island County Superior Court last week. Judge Christon Skinner found probable cause existed to believe Boese may have committed the crimes of rape in the first degree, kidnapping in the first degree, assault in the second degree with a firearm and interfering with the report of domestic violence.

In court, Chief Criminal Prosecutor Eric Ohme asked the judge to set Boese’s bail at $200,000. He said it was an “extremely serious crime” and there was a risk Boese would attempt to influence or intimidate the victim or the witnesses if released.

Attorney Matt Montoya, who represented Boese, asked that his client be released on his personal recognizance. He pointed out that Boese has no felony or domestic violence history.

In the end, Skinner set Boese’s bail at $100,000, saying the larger amount would be excessive.

The deputy’s report states that the woman brought her children to the Oak Harbor Police Department after escaping the house. She explained that she was divorcing Boese because of his methamphetamine and fentanyl use and that they were separated, the deputy’s report states.

The woman said she was home alone with the children and getting dressed in the bathroom when Boese entered, armed with a gun. After demanding a sex act, he pointed the gun “towards” her, but off to the side, the report indicates. He then forced her down and raped her, the report states.

The woman asked if he was going to kill her and he replied, “Maybe or I’ll kill myself,” the report states. He allegedly pointed the gun at his own head.

In addition, the woman said she tried to call 911, but he grabbed her phone and threw it, the report states. Boese allegedly held the door of the bathroom closed and put a nightstand in front of the door of the bedroom to prevent her from leaving, the deputy wrote.

The woman said she was eventually able to leave the bedroom when Boese moved to the side. She took the kids and left.
