A 33-year-old Oak Harbor resident agreed to go to prison for pointing a loaded handgun at his wife while their children were present.

Carlos Brown, a sailor in the Navy, pleaded guilty in Island County Superior Court earlier this month to assault in the second degree, a domestic violence crime.

Brown admitted that the crime was committed with aggravating factors, specifically that it was a domestic-violence assault and that it was committed within the sight and sound of the couple’s minor children.

Because of the aggravating factors, both the prosecution and defense recommended a sentence beyond the standard range of three to nine months in jail. Judge Alan Hancock obliged and sentenced Brown to a year and three months in prison, plus he ordered Brown to pay $1,317 in fines and fees.

In addition, the judge ordered Brown to undergo a treatment evaluation for domestic violence.

Sean Boyer, a special agent with Naval Criminal Investigative Service, investigated the allegation early this summer.

Brown admitted to pointing his semiautomatic Glock 23 pistol at his wife during an argument. Brown said the gun was loaded with hollow point ammunition, but no round was in the chamber at the time.

Brown told the special agent that he was angry at his wife during an argument and “wanted to scare her by pointing the gun at her,” Boyer wrote. A witness said the couple’s two children were present during the assault.

The victim reported that she and the children moved to Louisiana after the assault.
