A 26-year-old Freeland man got out of jail early this year and immediately went to an Oak Harbor motel to meet with a teenager a judge had barred him from contacting, according to court documents.

Prosecutors charged Joshua Kolbet in Island County Superior Court Nov. 16 with the attempted rape of a child in the third degree and felony violation of a court order with an aggravating factor.

The aggravating factor, according to the charging document, is that Kolbet allegedly committed the crimes shortly after getting out of jail. If convicted of the charges, Kolbet could face up to a year and eight months in prison under the standard sentencing range, plus an aggravating factor could increase that.

On March 12, Sgt. Jerry Baker with the Oak Harbor Police Department investigated a report that Kolbet was at a room at the Queen Anne Motel with a 15-year-old girl. A judge had issued a no-contact order barring Kolbet from having any contact with the girl.

Baker and another officer knocked on the door of the room and later found the girl hiding just outside a rear window, which she apparently crawled out of, Baker’s report indicates. The girl retrieved her belongings from inside the room before her father picked her up.

Baker wrote that he found an unused condom on the floor of the motel room, but the girl denied having sex.

The report states that Kolbet had two pending counts of violating the court order for allegedly calling the girl from the county jail.

Island County Superior Court Judge Alan Hancock set Kolbet’s bail at $100,000 on Oct. 22.
