An Oak Harbor man is accused of threatening his ex-girlfriend with a rifle on Aug. 20, according to court documents.

Prosecutors charged 34-year-old Michael L. Surgeon in Island County Superior Court Aug. 25 with assault in the second degree, a domestic violence crime.

Surgeon posted $10,000 bail on Aug. 25.

The alleged victim reported that Surgeon stole her ID and retrieved her car from an Anacortes towing company without her permission, according to a report by a deputy with the Island County Sheriff’s Office.

When she went to a Lato Drive home to get her car, Surgeon allegedly told her he had disconnected the battery and it wouldn’t start. She tried to get into the vehicle, but Surgeon raised a rifle in her direction, the report states.

The charging document indicates that the firearm was a .22-caliber rifle.

“She stated that she felt that she was going to be shot,” the report says.

The woman got into a friend’s truck and they drove off.

If convicted of the crime, Surgeon could face three to nine months in jail under the standard sentencing range.
