A 23-year-old Oak Harbor man is facing a felony charge and possible prison time after allegedly violating a no-contact order banning him from seeing his ex-wife, court documents indicate.

Prosecutors charged Devin Ness in Island County Superior April 12 with felony violation of a court order and fourth-degree assault, a domestic violence charge.

According to a police report, Ness went to his ex-wife’s home, uninvited, in the early morning hours of April 10 and started yelling at her about her new boyfriend. He punched her in the face once and left, the report states.

A violation of a court order becomes a felony if a person has two or more prior convictions of such. Court documents state that Ness was convicted of violating a court order twice before. The police report also indicates that Ness had previously assaulted his ex-wife.

If convicted of the charges against him, Ness would face from a year to a year and two months in prison under the standard sentencing range.
