Oak Harbor man accused of sending child porn through Facebook

A 37-year-old Oak Harbor man allegedly sent child pornography to a stranger through Facebook, according to court documents.

Roderick R. Balos pleaded not guilty in Island County Superior Court Monday to a single count of possession of depictions of minors engaged in sexually explicit conduct in the second degree.

If convicted of the charge, Balos could face up to nine months in jail under the standard sentencing range.

The police started investigating Balos after a man reported to police that Balos sent him an image of child porn over Facebook, according to the police report. The man had contacted Balos because he was interested in purchasing a tool bag and automobile-related items he had for sale.

Balls sent the man several images of several images of automobile fluid followed by a child porn image, the report states. It was unclear from the report whether Balos may have sent the image by accident.

After police contacted Balos, he allegedly told an officer that he was watching “chubby woman porn” when he received a spam message containing child porn.

A detective with the Island County Sheriff’s Office analyzed Balos’ phone and discovered images of child porn, the report states.

The report suggests that evidence points to the possibility that some of the images may be of a child Balos had contact with, but he was only charged with possessing images.
