Oak Harbor man, 19, charged with sex with girl, 14

A 19-year-old Oak Harbor man is facing a felony charge for allegedly having sex with an underage girl, court documents indicate. Prosecutors charged Robert Andres in Island County Superior Court July 25 with rape of a child in the third degree. Under the definition of the charge, an adult is guilty of the third-degree rape of a child if he has sex with a child who is at least 14 but less than 16 years old.

A 19-year-old Oak Harbor man is facing a felony charge for allegedly having sex with an underage girl, court documents indicate.

Prosecutors charged Robert Andres in Island County Superior Court July 25 with rape of a child in the third degree. Under the definition of the charge, an adult is guilty of the third-degree rape of a child if he has sex with a child who is at least 14 but less than 16 years old.

If convicted of the charge, Andres could face up to two years and three months in prison under the standard sentencing range.

Oak Harbor Police Officer Jennifer Porter investigated the case after the alleged victim’s older sister reported that their mother wasn’t taking good care of the younger girl. She said the girl was having sex with an older man and smoking pot, but her mother didn’t care.

Porter and a detective interviewed the 14-year-old girl in July. She admitted to having sex with Andres, who lived at her home and shared a bedroom with her after he got out of jail on another charge, the police report states.

The officers also interviewed Andres. He admitted to having sex with the girl multiple times even though he knew she had just turned 14 years of age, Porter wrote.

Andres allegedly told the officers that he’s a heavy drug user and doesn’t know why he did it, court documents state.

The girl was released to the custody of Child Protective Services.
