A driver in a March 30 head-on crash on North Whidbey is facing a criminal charge.

Oak Harbor resident Westyn Sillavan, age 22, appeared in Island County Superior Court March 31 and the judge found probable cause existed to believe he committed the crime of vehicular assault. The judge set Sillavan’s bail at $5,000.

Just after 11 p.m. March 30, Sillavan was driving north on Highway 20 in a Ford Explorer when he crossed the centerline, colliding with an oncoming Cadillac ATS driven by 39-year-old Marc Davis, according to a Washington State Patrol report.

A report by a state trooper states that Davis was unconscious at the scene and suffered an apparent head injury. He was taken from the scene in an ambulance and then immediately airlifted to Harborview Medical Center in Seattle for treatment.

Sillavan was walking around when the trooper arrived. He said he had fallen asleep after driving a friend home and stopping for food at McDonald’s, the trooper wrote.

The trooper noted an odor of intoxicants coming from Sillavan, who initially denied drinking alcohol but said he had smoked marijuana. But when asked to do a voluntary Breathalyzer test, Sillavan admitted to consuming whiskey about an hour before the crash, the report states. The test showed a blood-alcohol level of 0.115, which is over the legal limit of 0.08.
