The alleged theft of pornographic magazines and movies from an Oak Harbor convenience store led to a felony drug charge for a 20-year-old homeless man, court documents indicate.

Prosecutors charged Gary England in Island County Superior Court Jan. 11 with possession of heroin, possession of a dangerous weapon and theft in the third degree.

England didn’t appear at a Jan. 24 court hearing because he was at an in-patient drug treatment center, records indicate.

Sgt. Larry Ferguson with the Oak Harbor police investigated a report of theft at the DK Market on Highway 20 on the night of Jan. 7. A clerk said that a man who had stolen pornographic materials the night before had returned to the store, but ran off after the clerk confronted him.

Ferguson identified the suspect as England from store surveillance footage.

According to the officer’s report, the video footage from the night of Jan. 6 showed England going into a curtained-off area where pornography is sold. England stuffed a number of magazines and DVDs into his jacket, Ferguson wrote.

Ironically, Ferguson and a couple of other officers had contacted England a few hours after the alleged theft over a suspected car prowl. Ferguson had looked in England’s backpack and saw a bunch of pornographic magazines and DVDs.

Early in the morning on Jan. 8, officers found England in the Safeway area and arrested him. The officers retrieved England’s backpack from a garbage container and found a pair of “metal knuckles” inside. Ferguson found a plastic bag containing a trace amount of suspected heroin in England’s pants pocket, the report states.

The report shows that England is homeless and “staying wherever he can.”

On Jan. 10, Judge Vickie Churchill set England’s bail at $10,000. He made bail three days later.
