A court hearing over a motion meant to prevent a Freeland low-income housing project from moving forward didn’t happen Monday.

A judge in Island County Superior Court was scheduled to hear arguments on a preliminary injunction filed by Freeland Concerned Citizen LLC against county commissioners, the Low Income Housing Institution, commonly known as LIHI, and several other entities and individuals.

Freeland Concerned Citizens LLC alleges that the county commissioners violated the Open Public Meetings Act and citizens’ rights to due process, among other allegations, in awarding LIHI $1.5 million to help facilitate the purchase of Freeland’s only motel. LIHI plans to convert the motel into housing.

At least four different attorneys, including a deputy attorney general, filed responses to the LLC’s motion. And then the attorney for the Freeland Concerned Citizens filed responses to the responses.

Several attorneys as well as other interested parties showed up for the hearing scheduled for Monday morning. But late last week, one of the attorneys filed a notice of disqualification against Judge Christon Skinner, who was previously involved in legal action against LIHI. As a result, the case was transferred to Judge Carolyn Cliff.

Due to this change and other legal issues, the hearing was cancelled and will be rescheduled for the week of Aug. 15.
