A Freeland man accused of stabbing his mother to death in 2023 was recently sent to Western State Hospital for another psychological evaluation.
Justin Wiener is pleading not guilty by reason of insanity to murder in the first degree. He is accused of killing 53-year-old Brenda Wiener inside the RV that they both lived in.
Island County Prosecutor Greg Banks filed a motion for a pre-trial evaluation by a state expert. The motion states that the defense already obtained an evaluation which concludes that Wiener was insane at the time of the offense.
The evaluation at Western State Hospital, the state’s mental health treatment facility, may include both psychological and medical tests, the motion states.
A psychologist who works for the state previously evaluated Wiener in the Island County jail to determine whether he was competent to stand trial. Amy Parsons concluded that Wiener likely has the capacity to understand the nature of the legal proceedings and has the capacity to assist his attorney. He has no past criminal history.
But in addition, Parsons diagnosed Wiener with schizotypal personality disorder, delusional disorder and cannabis use disorder.
Her report describes Wiener’s troubled mind and delusions. The evaluation does not discuss the crime or the possible motive, but it describes his paranoid thoughts about his mother and others. He spoke at length about the water being poisoned and water bottles changing colors.
While Wiener reported that he had not previously been diagnosed with a mental disorder, a health provider noted that he presents with “hypochondria and/or other delusional health disorders,” the report states.
Parsons wrote that Wiener believes that he has a serious but undiagnosed physical ailment and has experienced “wakeful comas” that he thinks may be caused by a rare fungal infection. He purchased a professional microscope to study what he believed to be “a fungal infection that cannot be detected by medical professionals because of the particular composition of the bacteria,” the psychologist wrote.
Wiener was not employed at the time of the murder; he smoked pot every day and played video games about 10 hours a day, the report states.
In jail, Wiener was moved to a different block for his safety after other inmates complained that he made them uncomfortable by talking about “his crime,” according to the report.
Wiener allegedly murdered his mother on Nov. 17, 2023 and then walked to Nichols Bros. Boat Builders with blood-covered hands and said he wanted to report a crime he committed, according to court documents.
Justin Wiener later told a deputy that he originally planned to commit suicide after killing his mother, but he instead decided he was going to accept whatever “is coming my way,” according to a report by a deputy with the Island County Sheriff’s Office.
After being read his Miranda rights, he told the deputy that he loved his mother and wanted to give her the most painless death possible. He tried to strangle her and then stabbed her and cut her throat, the deputy wrote, and then threw the knives into the garbage.
