Man who escaped naked sent to prison

A Coupeville man who escaped a traffic stop in the nude last November was recently sent to prison.

Codie Burley, 21, pleaded guilty in Island County Superior Court to residential burglary, possession of a stolen firearm, assault in the third degree, possession of methamphetamine and two counts of possession of stolen property in the second degree.

Under the plea bargain, the prosecution and defense recommended a sentence of three years in prison and $1,280 in restitution to a burglary victim. The judge agreed and imposed the sentence.

Also under the plea bargain, charges were dropped against Burley in two other burglary cases and in four misdemeanor cases.

The burglary victim wrote an unusually colorful victim-impact statement.

“He violated my home,” the victim wrote. “It made me want to kick his punk ass. Thanks for prosecuting him.”

Deputy Robert Mirabal with the Island County Sheriff’s Office suffered a torn pectoral muscle during his roadside struggle with Burley and had to have surgery.

According to the police report, Mirabal pulled a car over on Patmore Road and recognized Burley as the passenger; Burley was wanted on outstanding arrest warrants at the time.

The deputy pulled Burley from the car, but the young man resisted as he tried to put him in handcuffs.

Burley was able to escape from Mirabal several times, only to be tackled again by the deputy. During one struggle, Burley wriggled out of his sweat pants to get away.

Mirabal later grabbed Burley by the shirt, but Burley pulled out of it and ran away naked.

Mirabal realized that one of his arms was injured and not functioning as he ran after Burley, who got away by going over a fence that the injured deputy wasn’t able to traverse.

A deputy obtained a search warrant for the car and found several items, including a gun and a medieval sword, that had been taken during a burglary. In addition, the deputies located “a large crystalline rock” of suspected meth in a plastic bag.

That night, deputies served a search warrant on Burley’s residence on Patmore Road and found him hiding in a bathroom.
