A man is accused of raping a woman in an abandoned house in Oak Harbor in August, according to court documents.

Christopher Smith, 35, pleaded not guilty in Island County Superior Court last month to a single count of rape in the third degree. He’s being held in jail on $25,000 bail.

If convicted, Smith would face from 15 to 20 months in prison under the standard sentencing range.

The 29-year-old victim reported to police that Smith had sexually assaulted her Aug. 31 after they ended up in an abandoned house in order to sleep. She said she was able to fight him off and escape.

The woman first went to WhidbeyHealth Medical Center in Coupeville for a sexual assault exam, but she was discharged and referred to Skagit Hospital, the police report states.

Initially, the woman didn’t want to report the rape to police but she later changed her mind. Under state law, victims are able to have a rape kit completed and remain anonymous; they have 30 days to change their minds and report the crime, according to a court document.

In a separate case, prosecutors charged Smith this week with seven counts of identity theft in the second degree and two counts of forgery.
